These Terms of Use (“Terms”) govern your access to and use of the telehealth services provided through the website telegomed.com, any mobile or web applications we publish, and related services (collectively, the “Platform”) operated by GoMed Pte Ltd (“GoMed”, “we”, “us” or “our”), a company incorporated in Singapore (UEN: 202603496W) with registered address at 60 PAYA LEBAR ROAD, #06-28, PAYA LEBAR SQUARE, SINGAPORE 409051.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Platform.

1. Eligibility

1.1 You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are 18 years or older and capable of forming a binding contract with GoMed.

1.2 You must be physically located in Singapore when using teleconsultation, e-prescription, or other clinical care functions.

1.3 Meeting the eligibility requirements does not guarantee that you will receive Services. We may decline, suspend, or restrict access where clinically appropriate or where we suspect misuse, fraud, or security/legal risk.

1.4 If you access or use the Platform on behalf of another individual (for example, a dependent or family member), you represent and warrant that you are authorised to act on their behalf and to provide their information to us.

2. Services

2.1 The Platform enables you to schedule and conduct online medical consultations (“Teleconsultations”) with licensed healthcare professionals, receive clinical advice, and, where appropriate, obtain prescriptions and medication delivery.

2.2 All medical services are provided by qualified and licensed healthcare professionals. GoMed facilitates access to these services and does not itself provide medical advice, diagnosis, or treatment.

2.3 Any doctor-patient relationship is established solely between you and the healthcare professional providing care, and not with GoMed.

3. Telehealth Consent and Emergency Notice

3.1 What Telehealth Involves

Telehealth (telemedicine) refers to the delivery of healthcare services using electronic communications and digital technologies when you and a healthcare professional are not in the same physical location. This may include:

      • The transmission of medical records, photographs, videos, and other health information;
      • Real-time video or audio consultations, or asynchronous (non-real-time) communications; and
      • The use of data from devices or applications that you choose to share with your provider.

3.2 Benefits and Limitations

By using our telehealth Services, you acknowledge that:

      • Telehealth can improve convenience, access, and timeliness of care;
      • Telehealth may not be suitable for all medical conditions or situations;
      • Your provider may recommend an in-person consultation, further investigations, or referral where clinically appropriate; and
      • No specific outcomes or results can be guaranteed.

3.3 Security and Technical Risks

We implement reasonable technical and organisational safeguards to protect your information and the integrity of our Platform. However, telehealth involves inherent risks, including:

      • Technical interruptions, connectivity issues, or system failures;
      • Transmission delays or distortions of audio, video, or data; and
      • Potential unauthorised access despite appropriate safeguards.

3.4 Your Consent to Telehealth

By accessing and using telehealth Services on the Platform, you confirm that you:

      • Understand the nature, benefits, and limitations of telemedicine;
      • Voluntarily consent to receive care via telehealth from licensed healthcare professionals using the Platform;
      • Understand that your personal data and medical information will be handled in accordance with our Privacy Policy and applicable laws; and · May withdraw your consent to telehealth at any time by contacting contact@telegomed.com, recognising that this may affect your access to Services.

A record of your consent may be retained as part of your medical records.

3.5 Sharing of Information for Care and Safety

You acknowledge that your healthcare provider may share relevant information for:

      • Treatment and continuity of care;
      • Healthcare operations and quality assurance; and
      • Regulatory, safety, or professional obligations,

In accordance with applicable laws and our Privacy Policy.

3.6 Emergencies

The Platform is not intended for medical emergencies. If you experience urgent, severe, or life-threatening symptoms, you should:

      • Call 995 immediately, or
      • Go to the nearest Accident & Emergency (A&E) department or clinic.

3.7 Critical Care Notice

You should not rely on our telehealth Services for conditions requiring immediate, essential, or life-saving medical intervention. In such cases, you must seek urgent in-person medical care.

4. Your Account

4.1 If you create an account on the Platform, you agree to:

      • Provide accurate, current, and complete information;
      • Maintain the security of your account credentials;
      • Update information promptly if it changes;
      • Accept responsibility for all activities that occur under your account.

4.2 You must notify us promptly if you suspect any unauthorised use of your account or any security breach.

4.3 You agree not to:

      • Misuse the Platform or access it for unlawful purposes
      • Attempt to bypass security measures or interfere with the proper functioning of the Platform
      • Introduce malicious code, viruses, or harmful material
      • Collect or harvest data from the Platform without authorisation

4.4 GoMed may suspend or terminate accounts where we reasonably believe there has been misuse, breach of these Terms, or security or legal risk.

4.5 Singpass MyInfo

Where you choose to register or log in using Singpass MyInfo, you consent to the retrieval of your personal data from relevant government sources for the purpose of identity verification and pre-filling of required information.

You acknowledge that such data may be used to create or update your account, and certain fields may be non-editable to preserve data integrity in accordance with applicable guidelines.

Such data will be handled in accordance with our Privacy Policy.

5. Medical Disclaimer

5.1 Information provided via the Platform, including Teleconsultations and any advice, diagnoses, or treatment plans, is not a substitute for in-person medical evaluation when necessary.

5.2 Teleconsultations may not be appropriate for all medical conditions. You should seek urgent face-to-face care if you are experiencing a medical emergency or serious symptoms.

5.3 GoMed facilitates access to healthcare professionals through the Platform but does not itself provide medical advice, diagnosis, or treatment. Healthcare professionals are independent and are solely responsible for the care they provide.

5.4 Platform content that is not part of a medical consultation (including general health information, educational materials, coaching tips, or automated outputs) is provided for informational purposes only. It does not constitute medical advice and is not a substitute for professional medical assessment, diagnosis or treatment. You should always seek the advice of a qualified healthcare professional regarding any medical condition.

5.5 To the maximum extent permitted by law, the Platform and its content are provided “as is” and “as available”. We do not guarantee that the Platform will be uninterrupted, error-free, secure, or compatible with all devices or browsers, or that any information provided is complete, accurate, or current.

6. Prescriptions, Payments and Delivery

6.1 Prescription medications may be issued at the discretion of the healthcare professional following a Teleconsultation.

6.2 Fees and Pricing

Fees for paid services (including consultations, medications, and delivery) will be displayed on the Platform prior to purchase and may be updated from time to time. Prices include or exclude GST as indicated.

6.3 Payments

Payments are processed by third-party payment providers. GoMed does not store full card or bank details. To the extent permitted by law, GoMed is not responsible for the acts or omissions of such third-party providers.

6.4 Orders and Fulfilment

All orders, prescriptions, and fulfilment are subject to availability, clinical appropriateness, and applicable laws. We may refuse or cancel orders where necessary, including for safety concerns, stock availability, or verification failure.

6.5 Delivery

Delivery is available within Singapore, subject to serviceability by our logistics partners. Risk of loss passes upon delivery to the address you provide. You are responsible for ensuring accurate delivery details and for receiving any time-sensitive or temperature-sensitive items as instructed.

6.6 Refunds and Returns

All purchases are generally final, and we do not offer refunds or exchanges except where required by law or in cases of delivery error, damage, or verified quality issues.

If you receive a product that is defective, damaged, or incorrect, please contact us at contact@telegomed.com within 5 working days of delivery, together with clear photographs and your order details.

For safety and regulatory reasons, medications that have been dispensed are non-returnable except where required by law or where there has been a verified issue as described above.

7. Acceptable Use

7.1 You must not use the Platform to:

      • Violate any laws or third-party rights;
      • Upload unlawful, defamatory, obscene, hateful, infringing, or privacy-invasive content;
      • Misrepresent your identity or clinical information;
      • Collect or harvest data without our permission;
      • Interfere with the operation of the Platform or other users; or
      • Request or provide controlled or abusable substances contrary to law

8. User Content and Feedback

8.1 You are responsible for any information or content you submit through the Platform (including profile details, medical information, and communications), and you warrant that such information is accurate, lawful, and does not infringe any third-party rights.

8.2 By submitting content through the Platform, you grant GoMed a non-exclusive, worldwide, royalty-free licence to use, store, process, and display such content solely for the purpose of operating, providing, and improving the Services, in accordance with our Privacy Policy.

8.3 Any feedback, suggestions, or ideas you provide may be used by GoMed without obligation or compensation to you.

9. Intellectual Property

9.1 All content, design, text, graphics, software and other materials on the Platform (“Content”), as well as the Platform itself, are owned by GoMed or its licensors and are protected by applicable intellectual property laws.

9.2 You may use the Platform for personal, non-commercial purposes only. You must not reproduce, distribute, modify, create derivative works from, or otherwise use any Content without our prior written consent, except where permitted by law.

10. Privacy

10.1 Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect your personal data in accordance with applicable laws.

10.2 By using the Platform, you acknowledge and agree to the collection and use of your personal data as described in the Privacy Policy.

11. Third-Party Links

11.1 The Platform may include or rely on third-party services or providers (such as payment processors, pharmacies, laboratories, logistics providers, or analytics tools), as well as links to third-party websites.

11.2 GoMed does not control and is not responsible for the content, availability, terms, or privacy practices of such third-party services or websites. Your use of such services is subject to their respective terms and policies.

12. Limitation of Liability

12.1 You access and use the Platform at your own risk.

12.2 To the maximum extent permitted by law, GoMed, its affiliates, directors, officers, employees, agents, and healthcare professionals shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including loss of data, revenue, profits, or business opportunities, arising from:

      • Your use of, or inability to use, the Platform;
      • Any errors or omissions in the Content;
      • Any clinical decisions made by healthcare professionals;
      • Any delays, disruptions, or failures of delivery services.

12.3 To the extent that liability cannot be excluded under applicable law, GoMed’s total aggregate liability arising out of or in connection with the Platform or Services shall be limited to a reasonable amount, not exceeding SGD 2,000.

12.4 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, or for fraud or any liability that cannot be excluded under applicable law.

13. Indemnification

13.1 You agree to indemnify and hold harmless GoMed and its affiliates, directors, officers, employees, agents, and healthcare professionals from and against any claims, liabilities, damages, losses, costs, expenses (including reasonable legal fees) arising out of or in connection with:

      • Your use of the Platform;
      • Your breach of these Terms;
      • Your violation of any rights of a third party; or
      • Any information you provide that is inaccurate, incomplete or misleading.

14. Changes to the Terms

14.1 We may modify these Terms at any time by posting the updated version on the Platform with a revised “Last updated” date.

14.2 Your continued access to or use of the Platform after changes to these Terms constitutes acceptance of the updated Terms.

14.3 We may change, suspend, discontinue, or restrict the Platform (in whole or in part) at any time without liability.

15. Marketing, Analytics and Cookies

15.1 We send marketing communications only with your consent and in compliance with applicable laws, including the Personal Data Protection Act 2012 and Do-Not-Call obligations. You may opt out at any time by contacting contact@telegomed.com.

15.2 We use cookies and analytics/advertising tools (such as Google or Meta) as described in our Privacy Policy.

16. Suspension and Termination

16.1 We may suspend or terminate your access to the Platform immediately, with or without notice, where we reasonably believe you have breached these Terms, engaged in fraud, posed security or legal risks, or where required by law or regulators.

16.2 Upon termination, your right to use the Platform ends. Clauses which by their nature are intended to survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and General) shall continue to apply.

17. Governing Law and Jurisdiction

17.1 These Terms shall be governed by and construed in accordance with the laws of Singapore. You agree that the courts of Singapore shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

18. General

18.1 Entire Agreement

These Terms constitute the entire agreement between you and GoMed regarding your use of the Platform and supersede any prior agreements, representations, or understandings relating to the same subject matter.

18.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions shall continue in full force and effect.

18.3 No Waiver

Failure or delay by us to exercise any right or remedy under these Terms does not constitute a waiver of that right or any other rights. Any waiver must be in writing to be effective.

18.4 Assignment

You may not assign, transfer, or subcontract any of your rights or obligations under these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.

18.5 Third-Party Rights

A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act (Chapter 53B) to enforce any provision of these Terms.

18.6 Territory

The Platform and Services are intended for use in Singapore and may not be appropriate for use in other jurisdictions.

19. Notices and Communications

19.1 We may contact you via the Platform, in-app notifications, email, SMS, or telephone using the contact details you provide (e.g., for appointment reminders, service updates, delivery coordination, and administrative notices). You are responsible for keeping your contact details accurate and up to date.

19.2 Notices sent by us will be deemed received when delivered via the relevant communication channel, unless otherwise required by law.
